BOOKINGS, CANCELATION POLICY & PAYMENT

• All sessions are 50 minutes long, starting from the time of your scheduled booking.
• Sessions must be pre-booked & pre-paid to confirm your appointment.
• A 12-hour cancellation policy applies to all Reformer classes appointments. All Reformer class bookings must be cancelled 12-hours prior to your class. A late cancellation or no show will result in a full fee being charged or one of your classes being deducted from your Membership or Pack. A failure to cancel within 12-hours or to attend a class will result in the class being forfeited and does not entitle the participant to a refund, credit or reschedule class.
• A 24-hour cancellation policy applies to all booked appointments (Privates and Semi-Privates). All studio bookings must be cancelled 24-hours prior to your class. A late cancellation or no show will result in a full fee being charged or one of your classes being deducted from your Pack. A failure to cancel within 24-hours or to attend a class will result in the class being forfeited and does not entitle the participant to a refund, credit or reschedule class.
• Memberships are setup as auto payments. These payments are set up through Ezidebit and are renewed 24hrs before the series runs out. 
• Failed auto payments: Please be aware that any failed direct debit transactions will incur a fee of $6.60 charged to your account by our payment provider, Ezidebit. We kindly request you to ensure that your payment information is accurate and up to date to avoid any extra charge. Thank you for your understanding and cooperation.
• To cancel Membership Packs you must give written notice with a minimum of 2 weeks.
• Prices are subjected to change without prior notice.
• Bookings are made via website, email, phone, SMS or directly with one of the studio staff members.
• In case of abrupt interruption of attendance caused by unforeseen circumstances, a refund can be issued with and an admin fee of $50 will be applied.
• Owner and/or trainers reserve the right to restrict clients to a particular class type for safety reasons at their discretion. Owners and/or trainers reserve the right to turn clients away if they do not have the correct medical clearance.
• If a selected class is full, clients can request to be added to a wait list by phone, SMS or email. If a place in the selected class becomes available, participants will be notified by email and phone call or text message for Private and Semi-Private sessions.
• The Pilates instructor teaching the class may change without prior notice.
• Instructors and classes are subject to change without notice. Active Pilates reserves the right to cancel classes if necessary.

CLIENT CODE OF CONDUCT

In the studio, you agree/ consent:

• To use all equipment with care and as instructed by the trainer
• To always follow the directions and instructions of the trainer for your own safety
• To not disrupt the class or threaten the environment in any way
• To be respectful and courteous to other people in the class, including the trainer.
• To allow the instructor to use the required physical contact (i.e., tactile cue), during the studio session to facilitate the best possible teaching methods
• To give permission for the studio to seek medical attention on my behalf, if necessary, in the case of an emergency or incident
• To give permission for images in which I appear to be used by Active Pilates for publications on their social media accounts, website and/or marketing.
• That discrimination, bullying, sexual harassment, and victimisation directly or indirectly will not be tolerated nor accepted in any form towards any client and/or instructor/employee/contractor of Active Pilates.
• That Active Pilates has the right to remove you from the class and not permit you to return to the studio (in which case you will be refunded your remaining credits) if in their opinion there is a breach of the client code of conduct or any of Active Pilates’ T’s & C’s or policies.

ANIMAL POLICY

No animals are allowed inside the studio at any time. Active Pilates has the right to ask you to leave if you have brought an animal in the studio.

PRIVACY POLICY

This privacy policy sets out how Active Pilates ABN: 16477628207 and its related entities upholds your rights under the Australian Privacy Principles. This Privacy Policy for Active Pilates notifies you of what personal information of yours we hold, what we do with it, who we will disclose it to and how you can assess the personal information we hold about you. 

Active Pilates may change this Privacy Policy from time to time by updating this page. 

WHAT INFORMATION WE COLLECT

Active Pilates may collect the following information for your personal file, payment requirements, health, and progress assessment, contact details for next of kin in case of emergencies, demographic research and feedback reports:

• Name & Surname
• Contact information including email address and mobile.
• Date of birth
• Emergency contact person details
• Bank account and/or credit card details
• Payment history
• Demographic information such as postcode, preferences, and interests
• Other information relevant to customer surveys and/or offers.
• Sensitive information such as injuries, ailments or illnesses that will influence your session, health or the safety of yourself and the instructor.
• An individual is not obliged to provide their personal information to Active Pilates. However, without certain information it may not be possible for Active Pilates to fully provide its services and/or products to the individual. Active Pilates will never sell your information. All information is stored securely and treated with confidentiality. 

INTELLECTUAL PROPERTY

• All content, photographs, videos and any other materials on the Website, our Instagram page, Facebook page or remain the property of Active Pilates.
• You must not reproduce, copy, share, sell, or deal with any of our materials without our express written permission.

REFORMER CLASSES AND STUDIO PILATES SESSIONS

• By viewing, accessing, using, or participating in our Reformer Classes/Studio Pilates Sessions, you agree to be bound by these terms and conditions and our Privacy Policy.
• As with any form of exercise, participation in Reformer Classes/Studio Pilates Sessions, may involve certain risks to your health and safety. By participating in our Reformer Classes/Studio Pilates Sessions, you warrant that you are not suffering from any injury, illness or condition that may prevent you from safely participating in our Reformer Classes/Studio Pilates Sessions.
• The Reformer Classes/Studio Pilates Sessions may be physically strenuous, and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death.
• By participating in our Reformer Classes/Studio Pilates Sessions, you warrant that you are at least 18 years old or have your parent/guardian’s permission and supervision to participate in the Reformer Classes/Studio Pilates Sessions.
• By participating in our Reformer Classes/Studio Pilates Sessions, you understand that you’ll be doing Pilates exercises using Pilates equipment and small apparatus and you are aware of the risk the Pilates equipment can offer, including risk of fall and breaking of the equipment.
• By participating in our Reformer Classes/Studio Pilates Sessions, you are aware that suffering an injury can result in loss of work, decrease of quality of life and death.
• Active Pilates accepts no responsibility for any injuries or damage that may occur to the Participant and/or property during Reformer Classes/Studio Pilates Sessions.

LIABILITY WAIVER

By booking into an Active Pilates class, you agree that:

• Active Pilates is in no way responsible for the safekeeping of my personal belongings while I attend class.
• Active Pilates does not assume responsibility for any lost or stolen personal property. If you do become the victim of a theft, immediately report it to a Active Pilates staff member who will try and assist you.
• Classes may be physically strenuous, and you voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death.
• You, your heirs, assignees, or legal representatives fully release Active Pilates (and its associated entities, members, employees, and contractors) from any claim, loss, damage, or expense of any kind including in relation to personal injury, property damage/loss, or wrongful death, occurring at Active Pilates studio or elsewhere, whether caused by negligence or otherwise.
• Active Pilates accepts no responsibility for any injuries or damage that may occur to the Participant and/or property during classes.
• The Participant agrees to indemnify and hold Active Pilates harmless from all liabilities, claims, and expenses, including legal fees, that arise from the Participants use or misuse of the Website, Facebook Page or Instagram Page.
• Active Pilates may, in our absolute discretion, change these terms and conditions from time to time without notice to you.

SOCIAL MEDIA, FOTOS, FILMING AND PRIVACY POLICY 

Please read these terms and conditions carefully before participating in any activities at Active Pilates. By participating, you agree to grant Active Pilates the right to use content, pictures, and videos taken within the studio for social media and marketing materials. If you do not agree with any part of these terms, please inform Active Pilates in writing and refrain from participating in activities where such content may be captured.

1. Content Usage: a. By participating in activities at Active Pilates, you grant Active Pilates and its affiliates a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, adapt, publish, and display any photographs, videos, or other content (collectively referred to as “Content”) that may be captured within the studio premises. b. The Content may be used for promotional and marketing purposes, including but not limited to social media platforms, websites, brochures, advertisements, and other marketing materials associated with Active Pilates.
2. Grant of Rights: a. You represent and warrant that you have all necessary rights, permissions, and consents to grant Active Pilates the license to use the Content. b. You acknowledge that Active Pilates is not under any obligation to use the Content, and it reserves the right to select, edit, or modify the Content as it deems appropriate for its marketing purposes. c. Active Pilates shall have the right to use the Content without any further compensation to you unless otherwise agreed upon in writing.
3. Intellectual Property: a. Active Pilates shall retain all intellectual property rights in the Content used for its social media and marketing materials. b. You are prohibited from using or reproducing any of the Content without prior written consent from Active Pilates.
4. Consent and Release: a. By participating in activities at Active Pilates, you consent to the use of your likeness, image, and voice as captured in the Content for social media and marketing purposes. b. You release Active Pilates, its representatives, employees, and affiliates from any claims, demands, or liabilities arising out of or related to the use of the Content.
5. Content Privacy and Protection: a. Active Pilates Studio will make reasonable efforts to protect the privacy and confidentiality of personal information captured in the Content in accordance with applicable data protection laws and regulations. b. However, Active Pilates shall not be held responsible for any unauthorized use or access to the Content by third parties or for any breaches of privacy beyond its reasonable control.
6. Modification and Termination: a. Active Pilates reserves the right to modify, suspend, or terminate the use of Content for social media and marketing materials at any time without prior notice. b. Active Pilates may remove or delete any Content from its social media platforms or marketing materials upon written request from the individual who provided the Content, subject to applicable legal obligations.
7. Governing Law: a. These terms and conditions shall be governed by and construed in accordance with the laws of the jurisdiction where Active Pilates is located.
